Q: Does the government ever perform site visits of H-1B workplaces?
A: Yes. The Fraud Detection and National Security Directorate (FDNS), which is a part of USCIS, periodically will be directed to verify the information provided on an H-1B petition.
Q: How do they complete this verification process?
A: There are three different methods to verify employment conditions, job duties, salaries and compliance with immigration regulations: (1) on-site visit to the worksite(s) identified on the H-1B petition; (2) telephone, email or in-person discussion with the H-1B employee; and (3) telephone, email or in-person discuss with the employer representative who signed the H-1Bpetition.
Q: What questions would they ask?
A: FDNS investigators may ask questions related to:
- Duties
- Pay
- Schedule and hours
- Place(s)of physical employment
- Who supervises your work
- How often you engage with Health Carousel personnel and,
whether you were required to pay any of the legal fees or filing fees associated with H-1B processing
Q: Can I refuse to participate in the site visit?
A: You should not refuse to participate. You should, however, first confirm with Health Carousel how the request came to you and verification that it is a FDNS Site Investigation. Non-cooperation may lead to reviews based on available information, potentially resulting in petition denials or revocations.
Q: Would I know in advance if an officer is doing a site visit?
A: On-site visits are unannounced. Communication with the H-1B worker is usually coordinated by email or phone, especially if you are not working on the date that the Investigator visits the worksite.
Q: Is there anything I can do to prepare for a visit?
A: Review all the details of your assignment confirmation letter and your contract. If you have questions, please contact your IES.
Q: How long would the visits be?
A: An FDNS site visit is usually resolved in 30 minutes.
Q: Can my unit manager or Health Carousel be present or on the phone during the interview?
A: The Unit Manager is an employee of the client and would not be involved in the Site Visit. Health Carousel’s immigration attorney could be present on the call, but in almost all instances, this is not necessary. Please review the usual list of questions that the Site Investigator asks and let your IES know if you have any questions or concerns.
